1. About These Terms
These Terms and Conditions ('Terms') govern the use of the website theeverydaysacred.com.au ('Website'), online bookings, and your booking or attendance of Reiki, energy healing, sound bath/sound therapy, crystal healing, aura soma healing and related wellness services ('Services') provided by Nicola McCooe trading as The Everyday Sacred (ABN 26 415 353 108). By using the website, booking a session (in person or online), attending a session, or purchasing a voucher, you ('you', 'the Client') agree to be bound by these Terms.
2. The Practitioner
Sessions are provided by Nicola McCooe, holding the following training:
● Certificate in Energetic Healing — Nature Care College
● Tibetan Usui Reiki — Nature Care College
● Tibetan Sound Healing — Tibetan Sorig Luksung Clinic, India
● Sound Healing & Therapy — Mandala Yoga & Nature Cure Training Centre, Nepal
These qualifications relate to complementary and energetic healing modalities. Nicola is not a registered medical practitioner, psychologist or allied health professional.
3. Nature of the Services — Important Disclaimer
Not medical or psychological treatment. Reiki, energy healing, sound bath/sound therapy, crystal healing and aura soma healing are complementary and holistic wellness practices intended to support relaxation, stress reduction and general wellbeing. They are not a substitute for, and do not constitute, medical, psychiatric, psychological, chiropractic or other professional healthcare diagnosis, treatment or advice.
No medical claims. We do not claim that any Service can diagnose, treat, cure or prevent any disease, illness or medical or mental health condition. Any outcomes or experiences described (verbally, on the Website, in marketing, or by past clients) are personal and are not guaranteed.
Continue your existing care. You should not stop, delay or change any medical treatment, medication or professional mental health care because of anything experienced in or said during a session. Always consult a qualified doctor or mental health professional regarding any medical or psychological condition.
4. Client Health Disclosure and Suitability
You must tell us before your session if you:
● are pregnant, or may be pregnant;
● have epilepsy or a history of seizures;
● have a pacemaker or other implanted electronic medical device;
● have a heart condition, are recovering from surgery, or have a serious or unstable physical condition;
● have a diagnosed mental health condition, including psychosis, dissociative disorders, PTSD, or are currently in a mental health crisis;
● have any hearing sensitivity, tinnitus, migraine or sound-sensitivity condition (relevant to sound healing);
● are under the influence of drugs or alcohol; or
● have any other condition that may make participation unsafe.
If your session is conducted online (e.g. via video call or distance healing), please also ensure you are in a safe, private, seated or comfortable space, and are not driving or operating machinery during the session.
We rely entirely on the accuracy and completeness of information you provide. We may decline, modify, pause or end a session at our discretion if we reasonably believe it is unsafe to continue, without obligation to provide a full refund.
If you are experiencing a mental health crisis or thoughts of self-harm, our Services are not appropriate support — please contact Lifeline (13 11 14), 000 in an emergency, or another appropriate crisis service.
5. Assumption of Risk
Participation in energy and sound healing sessions may, on rare occasions, bring up strong emotional responses, physical sensations, or temporary discomfort (such as tiredness, emotional release, or mild disorientation) as part of the relaxation process. By attending a session, you acknowledge these possible responses and voluntarily choose to participate, understanding that outcomes vary between individuals and are not guaranteed.
6. Limitation of Liability
Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or other applicable law. Where our Services are not of a kind ordinarily acquired for personal, domestic or household use, our liability for breach of a non-excludable guarantee is, to the extent permitted by law, limited at our option to resupplying the Services or paying the cost of having the Services resupplied.
General exclusion. To the maximum extent permitted by law, and subject to clause 6(a), we exclude all liability (whether in contract, tort, negligence or otherwise) for any indirect, special or consequential loss, or for any injury, loss or damage arising from: (i) inaccurate or incomplete health information provided by you; (ii) your failure to follow reasonable instructions given before or during a session; (iii) a pre-existing physical or mental health condition; or (iv) your decision to attend a session against our advice.
No liability for medical outcomes. As the Services are not medical treatment, we accept no liability for any medical or psychological outcome, or for any decision you make regarding your health based on a session.
7. Bookings, Payment and Cancellations
Bookings. Sessions are booked online via our Acuity Scheduling booking system linked from the Website. By booking through Acuity you also agree to Acuity's own terms of use and privacy policy for the handling of your booking data.
Payment. Full payment is required at the time of booking via PayPal unless otherwise agreed in writing. Prices are in AUD and inclusive of GST where applicable. We do not store your card or PayPal account details — these are processed directly and securely by PayPal in accordance with PayPal's own terms and privacy policy.
Cancellations by you. Cancellations or rescheduling requests made at least 24 hours before your session will receive a full refund or credit. Cancellations made within 24 hours of the session, or non-attendance ('no-show'), will not be refunded.
Cancellations by us. If we need to cancel or reschedule a session (including for practitioner illness or venue issues), you will be offered a full refund or an alternative session time.
Vouchers and packages. Gift vouchers and pre-paid packages are valid for 12 months from the date of purchase unless stated otherwise, are non-refundable, and non-transferable to cash.
Late arrival. If you arrive late, your session may be shortened to finish at the originally scheduled time, at full price.
8. Online and Distance Sessions
Where a session is conducted online (via video call or as distance/remote energy healing), you are responsible for ensuring you have a stable internet connection, a suitable private space, and any required device or software. We are not responsible for interruptions caused by your internet connection or equipment. If a session is cut short due to a technical issue on our end, we will offer to reschedule the remaining time or provide a partial credit at our discretion.
9. Group Sessions and Sound Baths
For group sessions (e.g. sound baths), please arrive on time, switch phones to silent, and remain respectful of other participants. We reserve the right to refuse entry or remove any person who is disruptive, intoxicated, or whose presence poses a risk to themselves or others, without refund.
10. Minors
Clients under 18 years of age may only attend with the written consent of a parent or guardian and, unless otherwise agreed, must be accompanied by that parent or guardian for the duration of the session.
11. Photography, Audio and Recording
We may take photographs or video during group sessions for marketing purposes, including for use on the Website and social media. You may opt out by notifying us before the session begins. We will not use identifiable images of you without your consent. You must not record, photograph or livestream sessions (including other participants) without our prior written consent and, for group sessions, the consent of other attendees.
12. Website Use and Content
General use. You may browse and use the Website for personal, non-commercial purposes, including to learn about our Services and to make bookings. You must not use the Website in any way that is unlawful, disruptive to its operation, or infringes the rights of others.
No professional advice via the Website. Content on the Website (including blog posts, service descriptions and social media content) is general information only, provided for interest and marketing purposes. It is not personalised advice and should not be relied upon as such.
Third-party platforms and links. The Website integrates with or links to third-party services, including Acuity Scheduling (bookings) and PayPal (payments), and may link to social media platforms such as Instagram. We are not responsible for the content, availability, or privacy practices of these third-party services, which are governed by their own terms.
Availability. We do not guarantee that the Website will be available at all times or free from errors, and we may update, suspend or discontinue any part of it without notice.
13. Privacy
We collect and handle personal information (including health information you disclose under clause 4, and information collected through the Website, Acuity bookings, and PayPal payments) in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Health information will only be used to assess suitability for, and safely deliver, the Services, and will not be shared with third parties except where required by law, to process a booking or payment (e.g. with Acuity or PayPal), or with your consent. 14. Intellectual Property
All content on the Website and provided as part of the Services (including text, images, recordings, written materials, and The Everyday Sacred branding) is owned by or licensed to us and may not be reproduced, distributed or used commercially without our written permission.
15. Complaints
If you are dissatisfied with a Service, please contact us at info@theeverydaysacred.com.au or 0423 989 557 within 14 days so we can address your concern. If a matter cannot be resolved directly, you may contact NSW Fair Trading or another relevant consumer body.
16. Force Majeure
We are not liable for any failure or delay in providing the Services caused by events beyond our reasonable control, including illness, extreme weather, venue unavailability, internet or platform outages, or government restrictions. In such cases we will offer a reschedule or credit where reasonably possible.
17. Changes to These Terms
We may update these Terms from time to time. The version in effect at the time of your booking will apply. Updated Terms will be posted at theeverydaysacred.com.au.
18. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.
19. Governing Law
These Terms are governed by the laws of New South Wales, Australia, and the parties submit to the non-exclusive jurisdiction of the courts of New South Wales.
20. Acknowledgement
By using the Website, booking or attending a session, you confirm that you have read, understood, and agree to these Terms, and that you have disclosed all relevant health information as required under clause 4.
